Welcome to the website of Borski Fund Coöperatief U.A., having its registered office at Mauritskade 63, 1092 AD, Amsterdam, registered with the Dutch Chamber of Commerce with number 74431633 (together with its group companies and Borski Management B.V., registered with the Dutch Chamber of Commerce with number 75376695, hereafter jointly: “Borski Fund” or “we” or “us”). Borski Fund invests in female entrepreneurs by offering risk capital and growth capital.

 

Since 25 May 2018, each company that processes personal data of a European citizen is required to comply with the General Data Protection Regulation (hereafter: “GDPR”). The protection of your personal data is important to us. Through this Privacy Statement and Cookie Policy we provide you with more information about our implementation of the GDPR and what we do with your personal data.

What are personal data and which data do we process?

In short, personal data refers to any data that directly or indirectly enables the identification of a natural person. Borski Fund collects and processes personal data to the extent that there is a legal ground for doing so. That is primarily data that you provide to us yourself. Depending on the relationship we collect and process the following personal data:

 

  • personal data (such as first names, last name, date of birth, place/country of birth, nationality (s), marital status);
  • contact details (such as address, telephone number, e-mail address);
  • bank and payment details (such as account holder, bank account number / IBAN, bank identification code);
  • information about the job title and work situation (such as self-employed, employed);
  • information about the assets (such as the source of wealth, source of funds, the amount of the bank account balances, debts, other financial data); or
  • (copy) ID or passport.

 

In relation to our employees or applicants, we collect and process curriculum vitae, work experience, education, (copy) certificates, degrees and references.

 

Whose personal data do we collect and process?

Borski Fund processes personal data of persons with whom it cooperates, whether in the past, present or future. This includes:

 

  • entrepreneurs in which Borski Fund (potentially) invests or (potentially) provides financing to;
  • (potential) cp-investors or financers;
  • (potential) investors in Borski Fund;
  • ultimate beneficial owners of the (potential) business (co-)investors (in Borski Fund) or (potential) entrepreneurs;
  • visitors of our website;
  • contact persons of our business partners; and
  • employees or applicants.

 

Cookies on website  

With the use of cookies, we are able to store certain non-identifiable automatic data about the users of our website. Cookies are small text files that are automatically offered to your browser by the website. We use cookies that have a technical functionality. They ensure that the website works properly and that your preferred settings, for example, are remembered. These cookies are used to optimize the website. We also place cookies that track your surfing behaviour on our website. The information those cookies collect is used to optimally adapt the content of the website to the wishes and needs of the visitors to our websites. We do not use the so-called ‘tracking-cookies’.

Many social media providers are located outside the European Union and transfers your personal data outside the European Union. As a result, it might be possible that your personal data is not protected the same manner as within the European Union.

 

Lawful basis

Borski Fund may only process your personal data if there is a lawful basis for doing so. We process your data on the basis of at least one of the following lawful grounds:

 

  • if processing is necessary for the performance of an agreement you have with us;
  • if processing is necessary in order to comply with a statutory obligation;
  • if we have a legitimate interest in doing so; or
  • if you have given your explicit consent for the processing of your data.

 

For what purposes does Borski Fund process you data?

Borski Fund currently processes your data for the following purposes:

 

  • in order to perform under (an) agreement(s) that you have entered into with Borski Fund;
  • in order to reduce risks, for example by verifying that the data of investors / entrepreneurs and that their representatives are duly authorised;
  • in order to comply with legal obligations, for example, the identification and verification of business contacts;
  • in order to carry out marketing activities, in particular, keeping interested parties informed by means of newsletters of sending invitations for events;
  • in order to improve and innovate our services;
  • in order to reach out to you if required;
  • in order to keep and maintain an administration;
  • in order to perform (statistic) research;
  • in order to enter into and maintain an employee/employer relationship and in this respect to maintain a personnel, financial, time absenteeism and/or salary administration; and
  • in order to a enter into and maintain a relationship for the acquisition and execution of assignments and to keep a (financial) administration in relation thereto.

 

Proving your data to other parties

We may be required to provide information to regulators or other (government) agencies such as the Dutch Authority for the Financial Markets (AFM) or the Dutch Central Bank (DNB), as well as the Tax and Customs Administration.

 

Your personal data may also be shared with advisors, which investigate whether Borski Fund’s business operations comply with laws and regulations. Thereby only the required personal data will be shared.

 

Borski Fund will not sell your personal information to third parties for commercial purposes without your consent.

 

Service providers

We may share your data with other parties in the context of our service, such as IT suppliers or administration or payment providers. In accordance with the statutory provisions, we enter into processing agreements with these parties in order to regulate the manner in which they may process your personal data. This covers issues such as security, but also includes provisions to provide that parties are not allowed to use the personal data for their own purposes.

 

Your data within or outside the European Union

In principle, we keep your data within the European Union. However, it is possible that in providing our services your data will be processed outside the European Union if one of our service providers is located outside the European Union. In that case, we will observe the strict rules that apply to processing outside the European Union. We will ensure that there is an agreement with the other party that is in line with the current standards approved by the European Commission.

 

How does Borski Fund protect your personal data?

Borski Fund will take appropriate technical and organisational measures to protect your personal data against loss or any form of unlawful processing. Employees of Borski Fund are required to maintain confidentiality and they may not provide your personal data unlawfully or unnecessarily.

 

Your personal data will not be retained for a longer period than is necessary for the purposes for which they are processed. The law requires us to retain certain data for a period of time. This period may vary from a couple of months to multiple years.

 

Access, correction and deletion of you data

Right to review and adjustment

You have a right to know which personal data Borski Fund processes of you. In the event that the personal data that we process regarding you is incorrect, you have a right to request us to correct this.

 

Right to be forgotten

In certain circumstances you have a right to be forgotten. In the event of a request to be forgotten, we will first check what personal data is necessary for us to guarantee further provision of our services or necessary because we process your personal data on the basis of a statutory obligation. Only data that is not necessary or required can be deleted.

 

Right to restrict processing

In certain circumstances you have a right to request the restriction or suppression of your personal data.

 

Right to object processing

In certain circumstances you have a right to object to the processing of your personal data. Borski Fund may process your personal data on the basis of a legitimate interest. However, you may have a compelling reason for requesting us to terminate the processing. In such case, you have a right to object.

 

Data portability

You have a right to request Borski Fund to transfer your personal data to you. This right applies with respect to personal data that we process on the basis of both your permission or contract. We will transfer your personal data to you to the extent technically possible. This is called “data portability”.

Do you want us to approach you in the context of marketing?

In every marketing communication, we include a link where you can set your mail preferences to exclude the receipt of marketing messages from us. You can also register or unsubscribe for different types of messages from Borski Fund. It is also possible to opt-out completely from all marketing communication. In such case, you will no longer receive any marketing communication.

 

We will, however, continue to send you messages regarding your agreement with Borski Fund or general information about our services or organisation.

 

What is the scope of the responsibility of Borski Fund?

Our website contains hyperlinks to other websites. When you click on the hyperlink, you leave our website and you end up on the website of another party. Borski Fund has no control over the websites of third parties that are linked via the hyperlink. A different privacy policy applies to the use of these third-party websites. Borski Fund does not accept any responsibility or liability for (the operation and / or content of) third-party websites. The Privacy Statement of Borski Fund only relates to (personal) data that has been obtained through the website of Borski Fund or otherwise by Borski Fund. We therefore recommend that you carefully read the privacy policies of the other websites so that you know how they handle your personal data.
